The Legal Reality

Your Website Has Legal Obligations

The Americans with Disabilities Act prohibits discrimination against people with disabilities in places of public accommodation. Many courts have treated websites as places of public accommodation, though the federal circuits disagree on whether a site needs a connection to a physical location. If your site cannot be used by someone who is blind, deaf, or has a motor impairment, you are exposed to a claim under federal law.

In April 2024, the Department of Justice issued a final rule under Title II of the ADA mandating WCAG 2.1 AA compliance for state and local government websites. An interim final rule published April 20, 2026 extended the deadlines: entities with a total population of 50,000 or more must comply by April 26, 2027, and entities under 50,000 or any special district government by April 26, 2028. Federal courts continue to apply ADA standards to private-sector websites across every industry.

Over 5,000 ADA website lawsuits filed in 2025 UsableNet counted 3,195 in federal court and 1,919 in New York and California state courts. EcomBack counted a 37% year-over-year rise in filings in the first half of 2025. In the first half of 2025, most of the companies UsableNet found sued had less than $25 million in revenue.

A complete WCAG 2.2 evaluation — every page, image, form, video and document, with each failure’s severity and legal exposure. On WordPress we audit by template, because one broken layout repeats across every post that uses it. On Shopify we audit the theme’s sections and snippets plus the alt text on every product image — which lives in your admin, not your code, and which no theme edit or widget can supply.

WCAG Remediation

We fix violations in your source, not in a script layered over it. On WordPress that means a child theme or a site-specific plugin, never parent theme files, which the next update overwrites. On Shopify it means your theme’s Liquid sections and snippets, with the exact diff handed back to you — so a theme upgrade is a re-apply you can see rather than a silent reversal.

PDF Remediation

Every downloadable document must be tagged for screen reader navigation. PDFs sit outside your theme entirely — in the WordPress Media Library, or under Content › Files in Shopify — so no template fix and no widget ever reaches them. They are the most overlooked violation and a frequent target in demand letters.

Video Caption Services

Uncaptioned prerecorded video fails WCAG 1.2.2 at Level A. We caption your videos and deliver SRT and VTT files. On WordPress they attach directly to the core video block. On Shopify they cannot: the native video_tag output carries no caption track, so we wire captions through a theme-level video element or an external player that supports them — a limitation most vendors never mention.

Ours records what we tested and the platform boundaries we could not cross — on Shopify, checkout is Shopify’s own code and no vendor can remediate it. The Overlay Problem

Why JavaScript Widgets Don't Solve This

Overlay products attempt to auto-repair accessibility at render time. The FTC has acted against one overlay vendor’s compliance claims, accessibility professionals have signed a statement against the approach, and lawsuits keep landing on sites that run one.
